Money.<br /><br />I'm increasingly convinced that in the minds of big-name and big-firm civil litigation attorneys, concepts like "liability" and "fault" are directly proportional to the perceived depths of the defendants' pockets.<br /><br />Case in point: The Brady Campaign has no money; ergo, they cannot be at fault and carry no liability. The gun dealer, on the other hand, is an agent of the "gun lobby", which as we all know is awash with blood-stained cash [*snerk*]; they have the (perceived) deepest pockets, so they are automatically liable and at fault, even if they aren't.
